SERVICE AFTER THE SALE

7 Day Satisfaction Guarantee – August Haven provides a 7 day satisfaction guarantee from the date of delivery or pickup on all furniture maintained in its original condition, with the exception of consumables. Customers returning any product for a reselect or refund will be assessed a service and handling fee equal to 10% of the original purchase price. Delivery charges are not refundable on returns. Within the 7 day satisfaction guarantee period, August Haven allows one reselect per purchase. A reselection must be made within 14 days of the date of delivery or pickup. Upon expiration of the original 7 day period, merchandise is not eligible for return. Merchandise sold as “closeout” is covered by the 7 day satisfaction guarantee (except for consumables and cosmetics), but has no manufacturer’s limited warranty.

Bedding: 125 Day Comfort GuaranteeBedding products are nonrefundable. However, customers purchasing non-clearance, non-closeout bedding sets along with a qualifying mattress protector will receive a 125 day comfort guarantee. This guarantee states that if after 30 days you are unable to adjust to the comfort and support level of your new mattress, you have up to 125 days from the date of delivery or pick up to reselect another mattress. The mattress set must be maintained in its original condition. Within that 125 day period, August Haven allows one reselect per purchase with a service and handling fee of 10% of the original mattress purchase price.  That’s our comfort guarantee to help you Choose to Sleep Better!

Clearance Items – All merchandise sold as “Clearance” or “Floor Sample” is sold “AS IS” and not eligible for return. The 7 Day Satisfaction Guarantee and 125 Day Comfort Guarantee do not apply to any of these items.

Standard Manufacturer’s Warranty – Your merchandise may be covered by a manufacturer’s limited warranty which will typically provide for repair or replacement of defective furniture, at the manufacturer’s discretion. August Haven will provide the repair or replacement service for any manufacturer’s warranty. August Haven must preauthorize any merchandise that may be eligible for return due to product defect. Any merchandise that is determined by August Haven to be eligible for return must be returned within 14 days and/or a reselection must be made within 14 days.   Merchandise that was picked up by the customer must be returned by the customer; however, arrangements can be made for an August Haven delivery team to pick up the merchandise at the current delivery rate. All merchandise will be thoroughly inspected at the time of return and must be returned in its original condition, minus approved defects. Additional Service Options – For repairs not covered by a manufacturer’s warranty, August Haven can provide service in your home for a nominal trip fee and a labor charge at the current hourly service rate, in addition to the cost of any replacement parts. August Haven makes no warranties, expressed or implied, other than those set forth herein. August Haven hereby disclaims all other warranties, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

Custom Order Return/Cancellation – Cancellation or return of any custom ordered product will be assessed a service and handling fee equal to 25% of the purchase price.

Product Damage Reporting – You must inspect the merchandise immediately upon pickup or delivery. Any visible damage must be reported to August Haven within 48 hours of the merchandise pickup or delivery.

Preauthorization – Any merchandise that is eligible for return must be preauthorized by August Haven. All merchandise will be thoroughly inspected at time of return and any merchandise that is not found to be in original condition will not be authorized. Original Condition – Original condition includes, but is not limited to the following: no signs of wear or tear, scratches, nicks, stains, pet hair, smoke damage or missing parts.

PAYMENT

You agree to make payment in full at time of order, unless financed by an August Haven credit program with different terms. Sales contracts financed by August Haven credit programs are subject to credit approval. The receipt by August Haven of less than full payment shall not be a waiver of rights of August Haven. You shall pay all costs and expenses, including but not limited to collection fees and reasonable attorney fees, for collection of any overdue amount. The parties agree that title to the products sold pursuant to this contract shall pass on full payment by you or upon delivery/pickup of financed orders. This contract has not been audited and is subject to change if mathematically incorrect.

REFUNDS

All refunds are processed from our Corporate Office in Green Bay, WI. If you paid your order by cash or check, we will refund you by check within 10 business days after delivery or cancellation of your entire order.

DELIVERY

All delivery dates are subject to schedule availability. Please notify August Haven at least three (3) days in advance to change a scheduled delivery. Any delivery dates quoted by August Haven are estimates only. August Haven will make a good faith effort to meet estimated delivery dates, but shall not be held responsible for failure to do so, and in no event shall be held liable for any expense to its customer that may result therefrom. It is the intent of August Haven to provide our customers with the finest home furnishing delivery services. Our delivery personnel will exercise every reasonable precaution to protect your purchase and deliver in the safest and most efficient manner possible. Our personnel are instructed to deliver your purchase only if it can be accomplished safely and without damage to the merchandise and/or premises.

GOVERNING LAW

This sales contract shall be governed by and construed in accordance with the laws of the State of Wisconsin. August Haven is not liable for any delay or failure to perform on this contract caused by circumstances beyond our control, including but not limited to: fire, flood, other acts of God, labor disputes or inability to obtain product; and if any delay is caused by such circumstances, August Haven has the option to cancel this contract without liability to either party.

PRIVACY

You can browse our site without entering any personal information and therefore remain anonymous during your visit. However, we hope that all of our visitors will register with us so that we can learn more about our valuable customers and send them updated product information and provide personalized service. We will not sell or share your information with outside companies or third parties. When you purchase from our online store, we collect your name, billing and shipping addresses, phone number and e-mail address. You provide this information so we can process and ship your order. Your credit card information is captured through the checkout process by a reputable third-party merchant services provider for credit card authorization purposes only and is not kept on file with augusthaven.com.

ONLINE SECURITY

Your credit card is completely safe. Protecting your information is our highest priority. We have developed several safeguards to keep your information completely confidential. To proceed to checkout you must enter your user name and password. The checkout process itself employs Secure Sockets Layer (SSL) technology to insure your safety. SSL encrypts your order information and sends it to a secure server, making it impossible for the information to be decoded by a party outside of augusthaven.com. To check for security of your connection during checkout, look for the unbroken key or closed lock at the bottom of your browser window. This indicates SSL is active.

Errors & Omissions – We make every effort to ensure the information on our website is accurate and up-to-date. However, please note that our website may contain typographical errors or inaccuracies. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time, without prior notice (including after an order has been submitted). Such errors, inaccuracies or omissions may relate to product description, pricing, photography, promotion and availability and we reserve the right to cancel or refuse any order placed based on incorrect pricing or availability information, to the extent permitted by applicable law. Clearance and closeout item availability and pricing may vary by store.

Promotional Disclaimers – Sales exclude clearance, closeouts, floor samples, antiques & found objects, Fjords®, Tempur-Pedic® and gift cards. Offers do not apply to previous purchases. Custom orders require a 20% deposit. Promotions cannot be used in conjunction with any other offers.
